Prohibited & Restricted Businesses

This list sets out the business activities that may not be operated on the NewVia platform, and those that are accepted only on a case-by-case basis with supporting documentation. It applies to every business that uses NewVia to take bookings or accept payments, and forms part of our Terms of Service and Merchant Terms.
NewVia applies this list when screening businesses for onboarding as sub-merchants on our marketplace, and on an ongoing basis thereafter. Screening by NewVia is in addition to — and never a substitute for — the underwriting, verification and restricted-business rules applied by our licensed third-party payment providers. Where a payment provider prohibits an activity that is not named here, that prohibition applies, and NewVia will decline or offboard a sub-merchant on the instruction of a payment provider, without being required to give reasons.
1. Prohibited Activities
Accounts engaged in any of the following will be refused or removed, and payment acceptance disabled:
- Any product, service or conduct that is illegal in Malaysia or in the jurisdiction where the business or its clients are located;
- Adult services, sexual services, escort or companionship services, erotic massage, and adult content;
- Human trafficking, exploitation, or any service involving minors in an unlawful context;
- Unlicensed medical or clinical practice, prescription-only medicines, pharmaceuticals, or unapproved medical devices;
- Controlled substances, recreational drugs, drug paraphernalia, vapes, e-cigarettes, and tobacco products;
- Gambling, betting, lotteries, sweepstakes, fantasy sports with cash prizes, and gaming of chance;
- Cryptocurrency exchange, trading, mining, initial coin offerings, and non-fungible token sales;
- Multi-level marketing, pyramid or Ponzi schemes, referral chains whose income derives from recruitment, and "get rich quick" programmes;
- Money transfer, remittance, currency exchange, cash advance, payday or unlicensed lending, debt collection, debt settlement, credit repair, and other unlicensed financial services;
- Investment advice, trading signals, or any regulated financial service offered without the required licence;
- Weapons, ammunition, explosives, and their components;
- Counterfeit, replica, or infringing goods, and unlicensed use of third-party intellectual property;
- Hate speech, extremism, harassment, or discriminatory services;
- Any product marketed with unsubstantiated medical, curative, weight-loss, fertility, or anti-ageing outcome claims;
- Transaction laundering — processing payments on behalf of another person or business, aggregating third-party sales, or misrepresenting the nature of the business;
- Any activity appearing on the restricted-business list of the applicable payment provider or card network.
2. Restricted Activities (Case-by-Case, Documentation Required)
The following are permitted only where the business holds and can evidence every licence, registration and professional qualification required by law, and where services are delivered by appropriately qualified practitioners:
- Aesthetic and skin clinics — injectables, fillers, botulinum toxin, laser and energy-based treatments, chemical peels;
- IV therapy, hormone therapy, and other clinical wellness or longevity treatments;
- Physiotherapy, chiropractic, osteopathy, TCM, acupuncture, and other regulated therapies;
- Mental-health and counselling services, where practitioner registration is required;
- Nutritional supplements, cosmeceuticals and skincare sold alongside services — claims must be lawful and substantiated;
- Prepaid packages, credit bundles, class packs and long-term memberships with deferred delivery — these carry future-delivery risk, so we may require clear expiry terms, published cancellation terms, and reasonable package values;
- Franchise, multi-outlet and agency arrangements, where the entity receiving payouts must be the entity delivering the service;
- Mobile, home-visit and travelling practitioners, where identity and insurance evidence may be requested.
3. Screening and Enforcement
- We screen every business at onboarding against this list and against the applicable payment provider's rules, and the provider performs its own identity and business verification.
- We monitor accounts on an ongoing basis, including for dispute and refund rates, changes in the services offered, and mismatches between the business described and the payments processed.
- We may request additional documentation (licences, practitioner credentials, proof of address, ownership details) at any time.
- Where a breach is found we may, without prior notice, disable payment acceptance, suspend or terminate the account, withhold platform services, and report the matter to the payment provider or a competent authority. Funds may be held or reversed by the payment provider in accordance with its own terms.
